1. Introduction
1.1. Welcome to Gigbow Freelancer Marketplace (“Gigbow”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your use of our website, mobile application, and services (collectively, the “Platform”).
1.2. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
2. Definitions
2.1. “Freelancer” means an individual or entity offering services on the Platform.
2.2. “Client” means an individual or entity purchasing services on the Platform.
2.3. “Project” means the specific work or service being offered by the Freelancer and purchased by the Client.
2.4. “Services” means the services offered by Freelancers on the Platform.
3. Eligibility
3.1. To use the Platform, you must be at least 18 years old and have the authority to enter into these Terms.
3.2. You must provide accurate and complete information when creating an account on the Platform.
4. Account Registration
4.1. To access certain features of the Platform, you must create an account.
4.2. You agree to provide accurate and complete information during the account registration process.
4.3. You are responsible for maintaining the confidentiality and security of your account credentials.
5. Freelancer Obligations
5.1. Freelancers must provide high-quality services that meet the requirements of the Project.
5.2. Freelancers must communicate with Clients in a professional and timely manner.
5.3. Freelancers must deliver work on time and meet deadlines.
5.4. Freelancers must ensure that all work delivered is original and does not infringe on any copyrights or trademarks.
6. Client Obligations
6.1. Clients must provide clear and concise project requirements.
6.2. Clients must pay Freelancers in accordance with the payment terms agreed upon in the Project.
6.3. Clients must communicate with Freelancers in a professional and timely manner.
6.4. Clients must not attempt to circumvent the Platform or pay Freelancers outside of the Platform.
7. Payment Terms
7.1. Clients must pay Freelancers through the Platform.
7.2. Payment terms will be agreed upon by the Client and Freelancer before the start of the Project.
7.3. The Platform will charge a service fee to Clients for using the Platform.
8. Intellectual Property
8.1. Freelancers retain ownership of all intellectual property rights to their work.
8.2. Clients will own all intellectual property rights to the work delivered by the Freelancer upon payment in full.
8.3. Freelancers and Clients agree to indemnify and hold harmless each other against any claims or damages resulting from infringement of intellectual property rights.
9. Confidentiality
9.1. Freelancers and Clients must keep confidential all information and materials exchanged during the Project.
9.2. Freelancers and Clients agree not to disclose or use any confidential information for any purpose other than the Project.
10. Dispute Resolution
10.1. Any disputes arising between Freelancers and Clients will be resolved through negotiation and mediation.
10.2. If negotiation and mediation fail, disputes will be resolved through binding arbitration.
11. Termination
11.1. The Platform reserves the right to terminate or suspend any account for any reason.
11.2. Freelancers and Clients may terminate their accounts at any time.
12. Governing Law
12.1. These Terms will be governed by and construed in accordance with the laws of Pakistan.
12.2. Any disputes arising out of or in connection with these Terms will be resolved through the courts of Pakistan.
13. Changes to Terms
13.1. The Platform reserves the right to modify or update these Terms at any time.
13.2. Changes to these Terms will be effective immediately upon posting on the Platform.
